Creator Terms of Service

Effective Date: February 25, 2026

By registering as a Creator on Adcrush.app (“the Platform”), you agree to be bound by these Terms of Service. These terms govern your relationship with Adcrush and the Brands you collaborate with through our marketplace.

1. THE ADCRUSH MARKETPLACE

Adcrush provides a platform where Creators can discover Brand briefs and submit original ad content. Our goal is to facilitate “outlier ads” that drive revenue. We provide the tools (Dashboard, Meta Suite Integration) to track your success, but the creative execution is your responsibility.

2. ELIGIBILITY & CONDUCT

  • Professionalism: You represent that all information in your portfolio and profile is accurate.
  • Compliance: You agree to abide by the Adcrush Creator Code of Conduct.
  • Account Security: You are responsible for maintaining the security of your account credentials.

3. CONTENT SUBMISSION & LICENSING

  • Originality: You warrant that all content submitted is your original work and does not infringe on any third-party intellectual property rights (including music, trademarks, or personality rights).
  • Work for Hire: Unless otherwise specified in a Brand brief, all content approved and paid for by a Brand is considered a “work made for hire.”
  • Grant of Rights: Upon payment (either Flat Bounty or the initiation of a Performance-Based contract), you grant the Brand and Adcrush an irrevocable, worldwide, perpetual, royalty-free license to use, edit, distribute, and “boost” the content across all digital platforms, including but not limited to Meta (Facebook/Instagram), TikTok, and YouTube.
  • Adcrush Promotion: You grant Adcrush the right to use your content and likeness in our own marketing materials to showcase the platform’s capabilities.

4. COMPENSATION MODELS

Adcrush offers two primary payout structures. The specific model for each campaign will be defined in the Brand brief:

  • Flat Bounty: A one-time fixed fee paid upon the Brand’s final approval of the content.
  • Performance-Based: Compensation calculated as a percentage of ad revenue or specific conversion metrics generated by the content.
    • Verification: Performance data is pulled directly via our Meta Ads Suite integration. Our dashboard serves as the “source of truth” for performance metrics.
    • Payment Cycles: Performance payouts are processed according to the schedule defined in your Creator Dashboard (e.g., Net-30).

5. BRAND SAFETY & APPROVALS

  • Final Say: Brands have the absolute right to approve or reject content submissions. Adcrush does not guarantee that your submission will be selected or funded.
  • Revisions: Brands may request up to two (2) rounds of minor revisions (e.g., text overlays, different music, or slight edits) to ensure the content aligns with the brief.

6. META INTEGRATION & DATA

By using the Platform, you acknowledge that Adcrush connects to third-party APIs (like Meta Suite) to track ad performance. You agree not to interfere with this tracking or attempt to manipulate performance data through artificial engagement (bots, click farms, etc.). Fraudulent activity will result in immediate termination and forfeiture of all pending payouts.

7. INDEPENDENT CONTRACTOR STATUS

Your relationship with Adcrush is that of an independent contractor. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship. You are solely responsible for your own taxes, insurance, and equipment.

8. CONFIDENTIALITY

You may be privy to sensitive Brand information (unreleased products, marketing strategies, or pricing). You agree to keep all “Internal Only” brief details strictly confidential and will not share them outside of the Adcrush platform.

9. LIMITATION OF LIABILITY

Adcrush provides the platform “as-is.” We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform or your interactions with Brands. Our total liability to you shall not exceed the total fees paid to you through the platform in the six months preceding the claim.

10. TERMINATION

  • By You: You may stop using the platform at any time.
  • By Us: We reserve the right to suspend or terminate your account for violations of these Terms, the Code of Conduct, or for providing low-quality content that negatively impacts the marketplace ecosystem.

11. GOVERNING LAW

These terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New Jersey.
